Terms of Service

These Terms of Service ("Terms") govern your access to and use of PropVela (the "Platform"). By creating an account or using the Platform, you agree to these Terms. If you do not agree, do not use PropVela.

1. Who Operates This Platform

PropVela is a 100% Filipino-owned business — there is no foreign ownership or control of the entity operating this Platform. This is stated for transparency and in view of Philippine restrictions on foreign ownership and practice in real estate brokerage and related activities (e.g. the Anti-Dummy Law and the Philippines' foreign-ownership restrictions on private land and real estate services).

2. Account Types

PropVela offers three types of accounts:

• Agents — real estate professionals listing property on behalf of clients. By registering as an agent, you represent that you hold a current, valid Professional Regulation Commission (PRC) real estate license and any required accreditation under the Real Estate Service Act (RA 9646), and that the license/ accreditation details and ID document you provide are genuine and current. Providing false credentials is a violation of these Terms and may be reported to the relevant authorities. Agent accounts start on a free trial and convert to a paid subscription as described in Section 4; agents may also refer other agents to PropVela under the terms of our separate Agent Referral Program Terms.
• Private sellers/landlords — individuals listing their own property directly, subject to the listing-frequency limits in Section 3.
• Buyers/renters — individuals browsing listings, saving searches and favorites, and contacting agents/sellers about properties. Some features — saving a search or favoriting a listing, for example — require creating a free account. Our AI-powered search has a fair-use limit (currently 3 searches per hour, 6 per day per visitor); an option to purchase additional searches beyond that limit is planned but not yet available.

You must provide accurate registration information and keep it up to date. You are responsible for all activity under your account and for keeping your login credentials secure.

3. Listing Rules

• You are solely responsible for the accuracy of any listing you post — price, property details, photos, and legal status (including that you have the right to sell, lease, or list the property).
• Listing photos are automatically screened for inappropriate content and may be held for manual review before publication; we may reject or remove photos or listings that violate these Terms.
• Agent listing limits depend on your subscription tier (Section 4) — you may not have more active listings at once than your plan allows.
• Private-seller listing frequency: you may post one listing every six weeks, measured from when your last listing was created. A Portfolio Pack lifts that wait for the specific properties it covers — see below. If you find yourself listing property regularly, consider registering as an agent instead, which has no such limit.
• We may remove any listing, or suspend or terminate any account, that we reasonably believe violates these Terms, applicable law, or is fraudulent, misleading, or abusive.

4. Payment Terms

4.1 Agent subscriptions

• New agents get a 45-day free trial (10 active listings), no card required. You can add a card and choose a monthly plan starting 7 days before your trial ends.
• Monthly plans (10/30/100 active listings) are billed automatically each month once selected and your free period ends, until you change your plan or cancel. Prices shown are the exact amount charged — no separate processing fee is added.
• If no plan and card are added by the time your trial or free period ends, your active listings are hidden until you add a plan and reactivate.
• You may change your plan or cancel your subscription at any time from your dashboard. Cancelling doesn’t end your plan immediately — your account stays fully active (including your current listing limit) through the end of the billing period you’ve already paid for, and simply doesn’t renew after that. No partial refund is issued and no extra charge is made for that final period. You can undo a cancellation at any time before it takes effect.

4.2 Private-seller listing fees

• Private sellers pay a one-time fee per listing: a simple listing (photo, description, price, and sale/rental type only, either type at the same price) covers that listing for 3 months; a full sale listing (complete property details) covers 4 months; a full rental listing (complete property details) covers 3 months.
• A listing is published once payment succeeds.

4.3 Agent prepay upgrade

• At any point during your 45-day trial, you may add a card, choose a plan, and prepay 6 months (12% off) or 12 months (20% off) upfront instead of converting to a standard monthly subscription. Your trial extends to 75 days in total, and the prepaid term is charged immediately and runs from the end of that 75-day period.
• Once your prepaid term ends, your plan converts automatically to standard monthly billing at the same tier using the card on file, unless you change or cancel it first.
• The listing-fee non-refund policy in Section 4.5 applies to a prepay charge the same as any other listing fee.

4.4 Early Access

• If you register as an agent before PropVela launches, your account is held until launch day. You can set up your profile and add listings in the meantime, but nothing is public and nothing is charged until we launch.
• Your free trial does not start while you are waiting. It starts on launch day and runs for the standard 45 days from there.
• Refer another agent who registers before launch and you both get 7 extra free trial days, with no limit on how many you can refer. Referrals are recorded while you wait and added to your trial on launch day, for each referred agent whose account goes live. Each agent can be referred once.
• Early Access agents keep a permanent Early Access badge on their profile.

4.5 General

All payments are processed by PayMongo. Fees are non-refundable except where required by applicable law. We may change our pricing prospectively, with notice.

5. Prohibited Conduct

You agree not to:

• Post false, misleading, duplicate, or fraudulent listings.
• Provide false professional credentials or impersonate another person or business.
• List property you do not have the legal right to sell, lease, or advertise.
• Harass, threaten, or send unsolicited commercial messages to other users through the Platform.
• Scrape, crawl, or use automated means to access or extract data from the Platform without our written permission.
• Attempt to circumvent listing fees, subscription limits, or account restrictions.
• Upload content that is illegal, obscene, defamatory, or infringes another's rights.
• Interfere with or disrupt the Platform's operation or security.

6. Content Ownership and License

You retain ownership of the listing content and photos you upload. By uploading them, you grant PropVela a non-exclusive, worldwide license to host, display, resize, and distribute them on the Platform for the purpose of operating the service and reasonably promoting it — for example, a listing photo appearing in a featured-listings carousel, on an area page, or in a social-media share preview. This license ends when you remove the content or close your account, except where a copy reasonably needs to persist (e.g. in backups, or where content has already been shared as permitted above).

PropVela may offer to generate a draft listing description using AI — this is a drafting aid only, always editable, and never published without the listing owner reviewing and submitting it. You are responsible for the accuracy of your final listing content regardless of whether AI assistance was used.

Everything else on the Platform — its design, branding, logo, source code, and PropVela's own written content (including articles) — is PropVela's property or used under license. You may not scrape, copy, reuse, or redistribute it without our written permission, beyond what's needed for normal browsing (e.g. sharing a listing link).

7. Nature of the Platform / Disclaimers

PropVela is a listing platform that connects agents, private sellers, and buyers/renters — we are not a real estate broker, a party to any sale or lease transaction, and we do not verify property titles, legal status, or the accuracy of any listing. Any transaction you enter into with another user is solely between you and that user, at your own risk. Informational features such as pointers to official flood-hazard maps and weather forecasts are simplified, general-awareness signals only, are not professional hazard or weather assessments, and should not be relied on as such.

To be precise about what that means: PropVela does not employ agents. Agents who list on PropVela are independent professionals or businesses — PropVela is an advertising platform, a "shop window," that lets an agent market themselves and their listings to potential buyers and renters. We are not an agent's employer, principal, or business partner, and an agent's conduct — how they communicate, the advice they give, how they handle a transaction — is theirs alone, not something PropVela directs, supervises, or is responsible for.

Because of that, PropVela does not warrant, guarantee, or take responsibility for anything sold, rented, or leased through the Platform. Whether a listing is accurate, whether an agent, seller, or landlord behaves professionally, and whether a transaction goes well are matters for the parties actually involved — not PropVela.

This is also why our fees work the way they do. PropVela charges listing and advertising fees — agent subscription plans and private-seller/landlord per-listing fees, both described in Section 4 — for the advertising service itself. We do not charge any fee that depends on a sale or rental actually completing: no commission, no percentage of a transaction, and no involvement in whether a deal closes or on what terms. That's the basis for PropVela's position as an advertising facility rather than a party to any transaction — our fee is for the advertising, full stop, regardless of whether it leads anywhere.

8. Third-Party Services

PropVela links to or references third parties in places — for example, the banks listed for informational purposes on our Mortgage page, or payment processing through PayMongo. We are not responsible for the products, services, accuracy, or conduct of any third party, including a bank whose home-loan products we mention, or an agent, seller, buyer, or renter once you deal with them directly outside the Platform (by phone, email, or in person, for example). Any dealings you have with a third party, including payment for and delivery of goods or services, are solely between you and that third party.

9. Limitation of Liability

To the maximum extent permitted by Philippine law, PropVela and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from a transaction between users, inaccurate listing content, or reliance on informational features described in Section 7. Our total liability for any claim arising from your use of the Platform will not exceed the total fees you paid to PropVela in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold PropVela harmless from any claim, loss, or damage (including reasonable legal fees) arising from your use of the Platform, your listing content, or your violation of these Terms or applicable law.

11. Termination and Moderation

You may close your account at any time. We may suspend or terminate your account, with or without notice, for violating these Terms, non-payment of applicable fees, or conduct we reasonably believe is harmful to PropVela, other users, or third parties. This includes the moderation tools our platform administrators use day to day — hiding or removing a listing or a rating, and changing an account's status to hidden, suspended, or banned — which this Section 11 is the contractual basis for.

12. Governing Law

These Terms are governed by the laws of the Republic of the Philippines. Any dispute arising from these Terms or your use of the Platform will be subject to the exclusive jurisdiction of the appropriate courts of the Philippines.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you directly. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
